RuralRaadio.com – 7/24/24 -A 55-year-old Bayard man was ordered to pay restitution, serve limited time behind bars and spend a number of years probation for falsifying records to cover up embezzlement of postal union funds.
United States Attorney Susan Lehr announced Wednesday that Senior U. S. District Judge John Gerrard sentenced Donald Fox to four years of probation, and to serve five weekends in jail. Fox was also ordered to pay $14,874.05 in restitution to the National Association of Letter Carriers Branch 1836, and prior to sentencing, had already paid the union $9,746.07.
Fox served as the secretary and treasurer for the union out of Scottsbluff, Nebraska, from 2001 until he resigned in June 2021. Federal law requires that a labor union secretary annually file an accounting statement with the Department of Labor documenting annual losses, assets, liabilities, receipts, and disbursements. Between 2016 and 2020, Fox used union funds for personal expenses totaling $24,620.12. Read more at RuralRaadio.com.

Former Nebraska NALC Officer Indicted for Embezzlement of $24,620 and Filing False Reports
DOL – On January 18, 2023, in the United States District Court for the District of Nebraska, Donald Fox, former Secretary-Treasurer of National Association of Letter Carriers (NALC) Branch 1836 (located in Scottsbluff, Neb.), was indicted on one count of embezzlement of union funds in the amount of $24,620 and four counts of filing false reports, in violation of 29 U.S.C. 501(c) and 29 U.S.C. 439(b), respectively. The indictment follows an investigation by the OLMS Denver-St. Louis District Office.
DOL – Donald Fox, age 54, of Bayard, Nebraska, is charged in a five-count Indictment. Count I charges Fox with embezzlement and theft of labor union assets beginning on or about February 20, 2016 and continuing to on or about August 14, 2021. The maximum possible penalty if convicted is 5 years’ imprisonment, a $250,000 fine, a three-year term of supervised release, and a $100 special assessment. Counts II through V charge Fox with falsification of annual financial reports filed by a labor union beginning on or about March 20, 2017 and continuing to on or about March 31, 2020. The maximum possible penalty if convicted is 1 year imprisonment, a $10,000 fine, and a $100 special assessment.
