Former Postal Inspector files lawsuit credibly alleging current and retired Federal Postal Inspector supervisors, managers and executives of the service violated numerous civil and criminal laws

PEN – 5/19/19 – A former Postal Inspector filed a discrimination and wrongful termination Federal lawsuit (1:19-cv-652,see attached complaint) in the Eastern District of California (EDC) credibly alleging the United States Postal Inspection Service (USPIS) supervisors Mack Gadsden Jr, Jennifer Vincent-Hiland, executive (California, Hawaii, Guam) Raphael Nunez, executive (Washington, Oregon, Alaska, Idaho, Montana) Anthony Galetti, and executive (Colorado, Wyoming, Dakota’s, Kansas) Adam Behnen of violating multiple Federal laws of which progressed into the  commission of criminal perjury related violation(s) while under oath by those that testified in 2017 during the Equal Employment Opportunity Commission (EEOC) hearing presided over by Administrative Judge Katherine Kruse and/or false statements made on sworn affidavits and Office of Workers Compensation (OWCP) agency statement(s) dating back to 2011.

The case stems from an incident in 2011 when Behnen removed the former Inspector from his position because Behnen perceived the former Inspector as being mentally disabled after receiving a credible allegation that Gadsden Jr (accompanied by Vincent-Hiland) had violated both State and Federal laws related to trespass of the former Inspectors privacy fenced back yard at night over a holiday weekend looking in bedroom windows.  Behnen received assistance from Nunez and Galetti in fabricating a retaliatory justification decision to terminate the former Inspectors’ employment after multiple alleged unlawful Fitness for Duty exams (FFDE) failed to justify a “Unfit for Duty” termination.

Persons should be considered innocent until proven guilty in court of which could result in an excess of 5 years in Federal prison for each violation of perjury.

I expect the Inspection Service, AUSA and USPS OIG will not take the lawsuit seriously until the assigned judge is presented with a “Motion for Summary Judgement” containing over a dozen documented instances of perjury under oath, false misleading statements and lack of candor/obfuscations committed by the/a team leader(s), AICs and INCs suborned by the Inspector attorneys that are relevant to material issues directly pertaining to the violation(s) in the complaint and discovered during the investigation/discovery period. On the issue of “Whistleblower Protection Enhancement Act of 2012” the USPS OIG is/has been required to report to Congress all allegations and results of their investigations received alleging “Whistleblowing reprisal” since the initial Act prior to 2012 was made into law. The Postal Service OIG has yet to substantiate a single reported instance were the Postal Service was found to have violated the act. Simply looking at numerous OSHA complaints regarding the USPS filed in Federal court and those court decisions shows the OIG is obviously covering for the PO after judgements are issued.

  2. There is another former Postal Inspector with a case before the EEOC now that is almost identical to that of Inspector Mort’s, including numerous civil and criminal. This case occurred contemporaneously with Inspector Mort’s circumstances, which would dispel the idea the Inspection Service’s unlawful conduct was an isolated incident. In this case, the USPS OIG dismissed the Inspector’s complaint due to the fact they were not aware of the amendments to the Whistleblower Protection Enhancement Act of 2012. It’s pretty sad when the watchdog doesn’t even know what it is supposed to be watching for.

  3. Mr. Mort It is so terrible what you endured at the hands of the USPS. Praying that you are successful with your Federal Court Lawsuit.

    I am wondering if you could contact me personally to answer some questions, I also had a situation with the USPS and was “wrongly” terminated from the USPS after an on the job injury. I do not want to put it out their publicly right at this time.
