{"id":8663,"date":"2014-10-10T08:39:17","date_gmt":"2014-10-10T13:39:17","guid":{"rendered":"http:\/\/postalemployeenetwork.com\/news\/?p=8663"},"modified":"2014-10-10T08:39:17","modified_gmt":"2014-10-10T13:39:17","slug":"remedy-for-violations-of-pse-cap-conversions-not-terminations","status":"publish","type":"post","link":"https:\/\/postalemployeenetwork.com\/news\/2014\/10\/10\/remedy-for-violations-of-pse-cap-conversions-not-terminations\/","title":{"rendered":"Remedy for Violations of PSE Cap: Conversions, Not Terminations!"},"content":{"rendered":"<p><span class=\"news-date-inline\"><span class=\"date-display-single\">10\/09\/2014<\/span><span class=\"Apple-converted-space\">\u00a0<\/span>&#8211;<span class=\"Apple-converted-space\">\u00a0<\/span><\/span>The APWU and USPS have settled a dispute over the proper remedy for violations of contractual limits on the number of PSEs that can be on the rolls at any given time.<\/p>\n<p>Under the terms of the<span class=\"Apple-converted-space\">\u00a0<\/span><a href=\"http:\/\/www.apwu.org\/sites\/apwu\/files\/resource-files\/POSTAL-SUPPORT-EMPLOYEE-CAP-REMEDY-100314-REMEDY-FOR-VIOLATIONS-WEB-NEWS-ARTICLE-OCTOBER-2014.pdf\" target=\"_blank\">Oct. 3 agreement<\/a>,\u00a0any future violations in the Clerk and Motor Vehicle crafts will result in the conversion of PSEs to career in the district where the violations took place. <a href=\"https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2014\/03\/1aa-APWU-small.gif\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-7249\" src=\"https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2014\/03\/1aa-APWU-small.gif\" alt=\"1aa-APWU-small\" width=\"295\" height=\"182\" \/><\/a><\/p>\n<p>Prior to the agreement, the USPS took the position that management could simply terminate PSEs to stay under the cap. The APWU asserted that PSEs must be converted to career.<\/p>\n<p>\u201cIt was outrageous that any PSE could face termination for management\u2019s violations of the cap,\u201d said APWU President Mark Dimondstein. \u201cThis is a positive and productive resolution of the dispute that puts the rights and well-being of our PSE members first and foremost.\u201d<\/p>\n<p>To remedy past violations, the union and management agreed to convert 468 PSEs to career within 60 days. (These conversions must be in addition to conversions that result from the<span class=\"Apple-converted-space\">\u00a0<\/span><a href=\"http:\/\/www.apwu.org\/sites\/apwu\/files\/news-attachments\/nsb04-140324-residual-vacancies-mou_0.pdf\" target=\"_blank\">Memorandum of Understanding on filling residual vacancies<\/a>.)<\/p>\n<p>The parties will meet at the national level to determine where the 468 conversions will take place.<\/p>\n<p>The remedy for violations of the cap in the Maintenance Craft was resolved in a separate<span class=\"Apple-converted-space\">\u00a0<\/span><a href=\"http:\/\/www.apwu.org\/news\/web-news-article\/maintenance-craft-settles-dispute-custodial-staffing-will-convert-more-3150\" target=\"_blank\">Memorandum of Understanding dated July 9, 2014<\/a>.<\/p>\n<p class=\"last\">The Collective Bargaining Agreement allows for 20 percent PSEs in the Clerk Craft, 10 percent in the Maintenance Craft, and 10 percent in the Motor Vehicle Craft.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>10\/09\/2014\u00a0&#8211;\u00a0The APWU and USPS have settled a dispute over the proper remedy for violations of contractual limits on the number of PSEs that can be on the rolls at any given time.
