{"id":5509,"date":"2012-12-05T23:11:48","date_gmt":"2012-12-06T04:11:48","guid":{"rendered":"http:\/\/postalemployeenetwork.com\/news\/?p=5509"},"modified":"2012-12-05T23:11:48","modified_gmt":"2012-12-06T04:11:48","slug":"arbitrator-sustains-unions-safety-health-grievance","status":"publish","type":"post","link":"https:\/\/postalemployeenetwork.com\/news\/2012\/12\/05\/arbitrator-sustains-unions-safety-health-grievance\/","title":{"rendered":"Arbitrator Sustains Union\u2019s Safety &#038; Health Grievance"},"content":{"rendered":"<p><a class=\"highslide\" onclick=\"return vz.expand(this)\" href=\"https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2012\/12\/APWU-News1.gif\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-5510\" title=\"APWU-News\" src=\"https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2012\/12\/APWU-News1-300x168.gif\" alt=\"\" width=\"300\" height=\"168\" srcset=\"https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2012\/12\/APWU-News1-300x168.gif 300w, https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2012\/12\/APWU-News1.gif 495w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>In a ruling issued Dec. 3, Arbitrator Shyam Das sustained the union\u2019s position that Article 14 of the National Agreement, Safety and Health, is \u201ca joint process for addressing safety and ergonomic issues\u201d and that \u201ccharging the union for information it reasonably requests in good faith to fulfill its joint role and obligations \u2026 is not consistent with the overall structure and tenor of Article 14.\u201d<\/p>\n<p>He ordered the Postal Service \u201cto provide information reasonably requested by the union in good faith to fulfill its role and obligations under Article 14 \u2026 without exacting payment.\u201d<\/p>\n<p>\u201cThe significance of Arbitrator Das\u2019 award cannot be overstated,\u201d said Director of Industrial Relations Mike Morris.<\/p>\n<p>\u201cThe arbitrator provided a clear and unambiguous interpretation of the Joint Labor-Management Safety and Health Committees at all levels as well as the National Joint Labor-Management Ergonomic Committee.<\/p>\n<p>\u201cHe acknowledged the Union plays a major role and [Article 14] establishes a joint process for addressing safety and ergonomic issues. His analysis regarding the union\u2019s right to be heard and to have substantive responses to its agenda items is crucial and critical to all Joint Safety and Health Committees,\u201d said Morris<\/p>\n<p>\u201cThe Arbitrator\u2019s award restores the equality of representation between the Postal Service and the Union within the respective Joint Area and Local Safety and Health Committees,\u201d said Morris.<\/p>\n<p>Many locals have voiced frustration with the Postal Service\u2019s refusal or failure to cooperate on Safety &amp; Health matters.
