Clocker on July 20.\u00a0 Clocker, age 34, of Wilkes-Barre, Pennsylvania, was charged with one count of misdemeanor destruction of mail in a Criminal Information filed today in U.S. District Court in Scranton.<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-8129\" style=\"border: none;\" src=\"https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2014\/07\/dept-of-justice2.gif\" alt=\"dept-of-justice2\" width=\"220\" height=\"200\" \/><\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 1em; color: #171e24; font-family: Georgia, 'Times New Roman', Times, serif; font-size: 14px; font-style: normal; font-variant: normal; font-weight: normal; letter-spacing: normal; line-height: 19.6px; orphans: auto; text-align: start; text-indent: 0px; text-transform: none; white-space: normal; widows: 1; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: #ffffff;\">According to U.S. Attorney Peter Smith, Clocker is charged with delay and destruction of mail between January and March 2016.\u00a0 The charges stem from an investigation by the Office of Inspector General, United States Postal Service.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 1em; color: #171e24; font-family: Georgia, 'Times New Roman', Times, serif; font-size: 14px; font-style: normal; font-variant: normal; font-weight: normal; letter-spacing: normal; line-height: 19.6px; orphans: auto; text-align: start; text-indent: 0px; text-transform: none; white-space: normal; widows: 1; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: #ffffff;\">Along with the Information, a plea agreement was filed in which Clocker agrees to plead guilty to the delay and destruction of mail charge.\u00a0 The plea agreement must be approved by the court.\u00a0 Clocker faces a maximum of one year in prison and a $100,000 fine, Smith said.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 1em; color: #171e24; font-family: Georgia, 'Times New Roman', Times, serif; font-size: 14px; font-style: normal; font-variant: normal; font-weight: normal; letter-spacing: normal; line-height: 19.6px; orphans: auto; text-align: start; text-indent: 0px; text-transform: none; white-space: normal; widows: 1; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: #ffffff;\">Indictments and Criminal Informations are only allegations. All persons charged are presumed to be innocent unless and until found guilty in court.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 1em; color: #171e24; font-family: Georgia, 'Times New Roman', Times, serif; font-size: 14px; font-style: normal; font-variant: normal; font-weight: normal; letter-spacing: normal; line-height: 19.6px; orphans: auto; text-align: start; text-indent: 0px; text-transform: none; white-space: normal; widows: 1; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: #ffffff;\">A sentence following a finding of guilt is imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 1em; color: #171e24; font-family: Georgia, 'Times New Roman', Times, serif; font-size: 14px; font-style: normal; font-variant: normal; font-weight: normal; letter-spacing: normal; line-height: 19.6px; orphans: auto; text-align: start; text-indent: 0px; text-transform: none; white-space: normal; widows: 1; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: #ffffff;\">The maximum penalty under federal law is one year of imprisonment, a term of supervised release following imprisonment, and a fine. Under the Federal Sentencing Guidelines, the Judge is also required to consider and weigh a number of factors, including the nature, circumstances and seriousness of the offense; the history and characteristics of the defendant; and the need to punish the defendant, protect the public and provide for the defendant&#8217;s educational, vocational and medical needs. For these reasons, the statutory maximum penalty for the offense is not an accurate indicator of the potential sentence for a specific defendant.<\/p>\n<p style=\"box-sizing: border-box; margin: 0px 0px 1em; color: #171e24; font-family: Georgia, 'Times New Roman', Times, serif; font-size: 14px; font-style: normal; font-variant: normal; font-weight: normal; letter-spacing: normal; line-height: 19.6px; orphans: auto; text-align: start; text-indent: 0px; text-transform: none; white-space: normal; widows: 1; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: #ffffff;\">The case was investigation by OIG-USPS.\u00a0 The case is being prosecuted by Assistant United States Attorney Todd K.
