We have an update on a case that involved federal courts, immigration officials, firearms and a restraining order filed by a local woman.<\/p>\n<p dir=\"ltr\">Mauro Emilio Pennini was deported on March 1 after being found guilty of having a weapon while being under a restraining order. The case went to federal court because Pennini was on federal land when he was arrested. At the time he had a gun, handcuffs, ammunition and other items. <a href=\"http:\/\/aspenpublicradio.org\/post\/postal-worker-emilio-pennini-deported-us#stream\/0\">Read more<\/a><\/p>\n<hr \/>\n<h3 dir=\"ltr\">Department of Justice &#8211; U.S. Attorney\u2019s Office &#8211; District of Colorado<br \/>\n<span class=\"date-display-single\">Thursday, June 18, 2015<\/span><\/h3>\n<h1 class=\"node-title\">Aspen Postal employee arrested after being caught with firearm, knives and handcuffs on Postal property<\/h1>\n<div class=\"field field--name-field-pr-body field--type-text-long field--label-hidden\">\n<div class=\"field__items\">\n<div class=\"field__item even\">\n<p>DENVER \u2013 Mauro Emilio Pennini, age 56, of Aspen, a postal employee who worked at an Aspen post office was arrested based on a Criminal Complaint charging him with being the subject of a protection order in possession of a firearm and for possessing a firearm at a federal facility, the U.S. Attorney\u2019s Office and the U.S. Postal Service Office of the Inspector General announced.\u00a0 Pennini made his initial appearance before a U.S. Magistrate Judge in Grand Junction today, where he was advised of his rights and the charges pending against him.\u00a0 He is due back in court on June 23, 2015 at 1:30 p.m. in Grand Junction for a preliminary hearing and a detention hearing. <img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-8129\" style=\"border: none;\" src=\"https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2014\/07\/dept-of-justice2.gif\" alt=\"dept-of-justice2\" width=\"220\" height=\"200\" \/><\/p>\n<p>According to the affidavit in support of the Criminal Complaint, the U.S. Postal Service Office of the Inspector General received information from the U.S. Postal Inspection Service that a mail processing clerk was arrested in the Aspen Post Office on June 8, 2015 by Aspen Police officers.\u00a0 The clerk, Pennini, was arrested for violating a Civil Protection Order.\u00a0 The order was obtained on May 22, 2015, in Pitkin County District Court in Aspen by a female and two minors.\u00a0 The order, which later became permanent, was issued because the court found that Pennini constitutes a credible threat, that an imminent danger exists to the life and health of the Protected Persons named in the action, and sufficient cause exists for the issuance of a Civil Protection Order.\u00a0 It ordered that Pennini not contact, harass, stalk, injure the protected persons.\u00a0 On June 8, 2015, Pennini sent one of the protected persons a text message, which was the basis for the arrest.<\/p>\n<p>After arrest the defendant asked the police officers to get medication he needed out of his bag, which was kept on Postal property in an unlocked locker.\u00a0 When the police officer went to get the medication at the defendant\u2019s request, he found a Sig Sauer 9mm handgun loaded with 14 rounds of ammunition.\u00a0 He also found a switch-blade knife, 3 folding knives, a multi-purpose tool and knife, two sets of handcuffs and two magazines with 14 rounds of ammunition in each.<\/p>\n<p>\u201cThe U.S. Attorney\u2019s Office is committed to keep postal employees and their customers safe,\u201d said U.S. Attorney John Walsh.\u00a0 \u201cPossessing a firearm while under a protective order and while on federal property are violations of federal law and will be prosecuted.\u201d<\/p>\n<p>Executive Special Agent in Charge Joanne Yarbrough said, \u201cThe American public trusts that U.S. Postal Service employees will obey the law. When an employee of the Postal Service violates that trust, the U.S. Postal Service Office of Inspector General (USPS OIG) thoroughly investigates those matters. This type of alleged behavior within the Postal Service is not tolerated and the overwhelming majority of Postal Service employees, which serve the public, are honest, hardworking, and trustworthy individuals who would never consider engaging in any type of criminal behavior. The USPS OIG and U.S. Attorney\u2019s Office remain committed to holding accountable anyone responsible for such alleged violations. The public we serve can rest assured that the USPS OIG will continue to ensure the accountability and integrity of U.S. Postal Service employees.\u201d<\/p>\n<p>If convicted, Pennini faces not more than 10 years in federal prison, and up to a $250,000 fine for being the subject of a protection order in possession of a firearm.\u00a0 He also faces not more than 1 year in federal prison, and up to a $100,000 fine for possessing a firearm at a federal facility.<\/p>\n<p>This case was investigated by the U.S. Postal Service Office of the Inspector General.<\/p>\n<p>The defendant is being prosecuted by Assistant U.S. Attorney Bob Brown.<\/p>\n<p>A Criminal Complaint is a probable cause charging document.\u00a0 Anyone accused of violating a felony federal law has a Constitutional right to be indicted by a grand jury.<\/p>\n<p>The charges in the Criminal Complaint are allegations, and the defendant is presumed innocent unless and until proven guilty.<\/p>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Note: See Justice Dept.&#8217;s original press release below.
