{"id":14116,"date":"2016-02-15T09:16:53","date_gmt":"2016-02-15T14:16:53","guid":{"rendered":"http:\/\/postalemployeenetwork.com\/news\/?p=14116"},"modified":"2016-02-15T09:16:53","modified_gmt":"2016-02-15T14:16:53","slug":"significant-victory-for-nalc-in-national-arbitration-award","status":"publish","type":"post","link":"https:\/\/postalemployeenetwork.com\/news\/2016\/02\/15\/significant-victory-for-nalc-in-national-arbitration-award\/","title":{"rendered":"Significant victory for NALC in national arbitration award"},"content":{"rendered":"<p>NALC 2\/12\/16 &#8211; NALC has scored a significant victory in national arbitration involving the authority of regular panel arbitrators to provide a remedy when the Postal Service wrongfully causes a letter carrier to lose accrued annual leave.<\/p>\n<p>In an award issued Feb. 3, 2016, National Arbitrator Dennis Nolan has rejected the Postal Service\u2019s attempt to set a nationwide limit on the remedial authority of regular panel arbitrators based on the 440 hour annual leave carryover limit set forth in Section 512.32 of the<span class=\"Apple-converted-space\">\u00a0<\/span><em>Employee and Labor Relations Manual<\/em>. <img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-6526\" style=\"border: none;\" src=\"https:\/\/postalemployeenetwork.com\/news\/wp-content\/uploads\/2013\/08\/3-NALC-News-Small4.gif\" alt=\"3-NALC News Small\" width=\"254\" height=\"214\" \/><\/p>\n<p>In a case originating in Concord, CA, NALC had argued that an injured letter carrier, who was denied limited duty, was entitled to compensation for all lost annual leave, even if the amount awarded exceeded the 440-hour limit.<\/p>\n<p>The Postal Service appealed the case to the national level and asked the arbitrator to rule that any such remedy would be inappropriate in all cases.<\/p>\n<p>Consistent with NALC\u2019s position, Nolan refused the Postal Service\u2019s request and remanded the matter to regular arbitration for consideration of NALC\u2019s remedy request, based on the particular facts presented.<\/p>\n<p><a href=\"https:\/\/www.nalc.org\/news\/nalc-updates\/body\/USPS-Annual-Leave-Back-Pay-Award-Q11n-4Q-C-131000328.pdf\">Click here to read Arbitrator Nolan\u2019s award.<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>NALC 2\/12\/16 &#8211; NALC has scored a significant victory in national arbitration involving the authority of regular panel arbitrators to provide a remedy when the Postal Service wrongfully causes a letter carrier to lose accrued annual leave.
