APWU: National Reassessment Program Discriminated Against Injured Workers

APWU News – 03/23/2018 – The time is now for all current and former permanent-rehabilitation and limited-duty postal employees who were subjected to the USPS National Reassessment Process (NRP) between May 5, 2006 and July 1, 2011 to file a timely claim with the Postal Service to seek monetary damages and other relief.

The Postal Service has exhausted all of its administrative appeals in the class action discrimination complaint, McConnell v. USPS. The EEOC’s favorable decision, issued March 9, 2018, is final. The EEOC rejected the Postal Service’s request for reconsideration after finding the NRP discriminated against injured postal workers and violated their rights under the Rehabilitation Act. The Postal Service is now required to comply with a number of orders listed in the final decision.

More than 130,000 individuals, many belonging to the APWU, may benefit from this decision. Individuals were not required to file an EEOC complaint to be part of the class but members of the class are required to file a claim within 30 days of receiving notice from the Postal Service to avoid forfeiting any potential relief. Survivors of deceased class members are eligible and encouraged to apply within the designated time limits.  Notifications from the Postal Service were said to be mailed to all eligible class members on March 19 and 20.

The law firm who litigated the legal claims before the EEOC informed the APWU that they also made a mailing to all class members on March 24 and 26 that reportedly provides instructions and offers guidance with claim filing. If you did not receive a notification and you believe you should be part of the class, you can still submit a claim.  The law firm encourages claims to be filed no later than April 12, 2018.  The APWU was advised that this is the first step in the claims process.  They have a dedicated website, where we are told individuals can find filing instructions including where to send a claim, suggested claim forms, and more detailed information about the case, the decision and the claims process. We were further advised FAQ’s would be added to the site soon. The law firm has also indicated that it has launched a call center manned with paralegals to specifically offer assistance to claimants.  For more information visit  www.nrpclassaction.com; call (585) 272-0540 or toll free at (877) 272-4066; or consult an attorney of your choosing.

CAUTION: The APWU makes no representation about the accuracy or quality of the information being provided by the law firm. The claim form provided by the law firm commits claimants to being represented by these attorneys. Claimants should carefully review the terms of the retainer agreement, including how their chosen representative is paid. Claimants are not required to use a lawyer to make a claim. The APWU cannot endorse the use of any law firm to submit their claims and cannot give legal advice on making claims to the Postal Service or whether to retain legal assistance for any part of the claim process.

The most important thing is to not miss the filing deadline.

  1. same in st paul vmf and else ware to the union encouraged management to have me sit in a postal vehicle for 6 months in the winter which in Minnesota is very cold I asked the union pres of st paul for assistance and got a belly lusgh from him

  2. It is funny to me how APWU get to act as if they are here to help the poor disenfranchised people who were discriminated against by the Post Office in the name of reassessing them. My experience as a Union official at the time showed me that APWU was just as interested in getting rid of people who were injured on the job in an effort to not only create a two tiered pay group that would help the Postal Service save money by paying the newer employees much less money; but the new people would get APWU insurance as well as add to the fledgling Union dues. I know of Union Officials in Virginia that turned their heads when people were getting sent to new offices in the name of excessing, hoping to locate them away from stronger Union representatives. The next step would be “out the door”. I know of employees who were injured on the job who were denied work within their facilities at straight regular time, while that same work was given to healthy employees on OVERTIME. I know of employees being told that they were being reassigned under the NRP with one stroke of the pen, and the with the next stroke of the pen say that they were being reassigned due to Excessing. Clever and destructive lies that have sent people home as a burden on the Workmen’s Compensation Program. They would get paid a fraction when they got sent home due to false claims of no work available. I know of VETERANS that were denied opportunities to work in custodial jobs because the USPS and APWU wanted to make room for jobs for the newer employees, despite the fact that Veterans were only supposed to have custodial jobs. As a Union official, I was once told by a National Business Agent ” Why are you fighting for them, they are taking our jobs”, referring to the fact that I tried to help every employee that I knew was being treated horribly by these two entities. Employees injured on the job should be able to rest assure that the EL-505 and EL-507 were written so that they were interactive with their displacements. However, it became quite clear that the EL-507 and EL-505 were not consulted when the new effort began to rid the Postal Service of Limited duty to make room for the Newly classified employees. There is so much that manyl don’t truly understand. You want to know what really happens to USPS money, check how much goes into thwarting EEO complaints Follow the money to the legal teams. Look at the decisions being made by MSPB and EEOC that shows that their decisions has nothing to do with standing by those that has been wronged by the Postal Service, but it appears that they are trying to save the Postal Service from themselves. All it takes is one strong person, to tell the truth. All it takes is for one good leader to bring it all to a head. People are afraid to come forward because of the EXTREME lengths that the Postal Service goes through to silence people. People are afraid. The environment is toxic. There continue to be a Hostile Work Environment even though the Postal Service has gone through great lengths to rid itself of the term “Going Postal”. If only the public really knew.,,, All of this, I am saying is my opinion, but I can easily provide proof to my words.

  3. I never received my claim form from the postal service. And i know for certain that i am part of this class action lawsuit because i was informed about this around 2010 and was told that i did not have to do anything. However, the letters that were sent out between March 19 and 20 2018, I never received. Can you help me with this problem? Thanks
